Title IX and Protecting Women's Sports
Signed into law on June 23, 1972, Title IX made one promise: no American should be denied opportunity “on the basis of sex.”
For five decades that promise has transformed education and athletics — opening doors, funding scholarships, and building the most successful era of women's sports in history. It leveled the playing field in schools and universities across America.
Title IX was written to guarantee fair competition for women and girls — not to erase the very differences that make those protections necessary. Today that promise is under pressure, and defending it takes vigilance, advocacy, and action.

The Biggest Decision Yet
For the first time, the U.S. Supreme Court is weighing whether states can keep girls’ and women’s teams female. Two state laws are on the line — with a ruling expected by the end of June 2026.
Defends Idaho’s HB 500 (2020), the nation’s first Fairness in Women’s Sports Act. At issue: whether reserving girls’ teams for girls violates the Equal Protection Clause.
Defends West Virginia’s HB 3293 (2021). At issue: the Equal Protection Clause and whether Title IX should force the women’s category to include males.
Where it stands: the Court heard oral arguments on January 13, 2026, and a decision is expected by the end of its term in late June 2026. The outcome could set the rule for women’s sports nationwide.
